Terms and Conditions
General Travel Conditions
Dear customers,
The following provisions constitute the content of the travel contract to be concluded between the client and AMAPA TOURS GMBH, hereinafter referred to as “AMAPA TOURS”.
Please read these travel conditions carefully before booking!
1. Contract / Customer obligation
1.1. With the booking request, the client sends Amapa Tours a travel contract. The travel reservation becomes official when the client/agency receives written confirmation.
1.2. Full details, descriptions, and conditions of the trip will be sent in the travel confirmation.

2. Payment:
2.1. After receiving confirmation, a 40% deposit of the total package cost must be submitted within 7 days of confirmation to secure your reservation.
2.2. Full payment for the package must be submitted 30 days before the trip begins. We will not send reminders; please ensure you pay the balance on time.
2.3. Reservations made within 25 days of the trip will require full payment.
2.4. Bank details: Will be sent in a money order
3. Final documents:
3.1. Once full payment for the reservation has been received, travel documents, vouchers, a detailed day-by-day itinerary, hotel addresses, and travel tips, including passport and visa requirements, will be sent two to three weeks before the trip.
4. Services and price changes:
4.1. Price changes to the final program cost are possible. The described itineraries are subject to change, including substitution of hotels, activities, and routes. If a service is not provided and Amapa Tours is unable to replace it with another service similar to the original price, Amapa Tours’ liability shall not exceed the original cost of the services not provided. Amapa Tours does not own or directly operate any of the service providers.
4.2. If prices for services provided by companies such as Chepe or Baja Ferries increase, the additional cost must be paid by the customer, who will be informed immediately.
4.3. In the event of a devaluation of the Mexican currency, which affects the total cost of the package, Amapa Tours may immediately modify the prices established with your company, either by your company or by the client.
4.4. Amapa Tours is not responsible for incorrect information provided by organizations such as airlines or hotels. The client is obligated to follow the instructions given in the confirmed program and to be present at the meeting points to begin the activities scheduled according to the confirmed itinerary. Amapa Tours will not issue refunds for missed services.
5. Cancellation fees, reservation change fees:
5.1. If the client fails to comply with the payment schedule agreed upon with Amapa Tours, cancellations will be charged as follows:
5.2. Percentage per person on the total cost of the program:
50 or more days prior to the start of the program: 10%
49 – 40 days prior to the start of the program: 15%
39 – 30 days prior to the start of the program: 30%
29 – 20 days prior to the start of the program: 40%
19 – 10 days prior to the start of the program: 55%
09 – 03 days prior to the start of the program: 75%
02 days prior to the start of the tour or no shows: 95%
5.3. There are no refunds for tour cancellations. Additional costs such as airfare will be paid directly by the client.
5.4. The cancellation date will be taken into account when the client’s written cancellation is received at the Amapa Tours office. Cancellation fees apply even if the client transfers or changes their trip to another program or start date.
5.5 The client agrees that Amapa Tours GmbH will not be charged for other services such as flight, boat or train costs.
5.6 The client may submit a request to change the participant’s name before the start of the trip. The new participant will be required to comply with the tour conditions. Amapa Tours may reject the request if the new participant does not comply with the trip conditions, requirements, or when there is an official order.
5.7. Once accepted, a new participant agrees to cover the full cost of the trip and any additional charges that may arise.
5.8. Reservation changes to another date will only be accepted with confirmation from Amapa Tours. The client may transfer their original trip to another date. Amapa Tours will charge for reservation changes according to the conditions mentioned in section 5.2, if applicable. For special requests, such as changes to the hotel category or tour itinerary, Amapa Tours will charge an appropriate fee of 400 MXN per person.
5.9. If during the trip some services are not provided or the trip must be terminated before the confirmed itinerary, Amapa Tours will only refund the cost of the services not provided. This only applies if Amapa Tours receives reimbursement from the service providers involved. The client is not entitled to a partial refund under any circumstances.
6. Customer obligations, limitations and complaints:
6.1. If the client does not receive the travel documents on time, he or she must immediately inform Amapa Tours.
6.2. If any service is not provided during the trip, the client must immediately inform the guide and Amapa Tours. The guide or the local service provider are not authorized to provide any other service requested by the client that is not included in the program. The guide will receive complaints and must immediately forward them to Amapa Tours. If the complaint is against the guide and the program does not include guide services, the client must submit all complaints directly to Amapa Tours.
6.3. In the event of a lack of service, the customer must submit their complaint within 15 days of the trip. After this time, the customer will no longer be able to file complaints.
6.4. In the event of a service shortage or a problem with a service provider, the client is obligated to cooperate with the guide to avoid creating a tense atmosphere with other participants.
6.5. For confirmed groups, the list of participants must be sent one month before the start date.
7. Cancellation by Amapa Tours GmbH:
7.1 If the minimum group size is not met, Amapa Tours GmbH may cancel the tour 15 days before the start date. The client may take another or the same tour with equivalent services and prices, but a guide will not be included. If the minimum group size is not met, a private tour will be offered (which may incur an additional cost) or a full refund will be given.
7.2 Amapa Tours GmbH is not responsible for cancellation charges before or after the tour from other providers. This applies, for example, to airline tickets, visas, missed vaccinations, etc.
7.3 Amapa Tours GmbH reserves the right to decline, accept, or retain any person as a member of a tour at any time or during the operation of the tour.
8. Cancellation due to out of control situations or natural disaster problems (Hurricanes – landslides – floods – earthquakes):
8.1 Amapa Tours reserves the right to cancel any tour at any time if there is a situation beyond its control such as natural disasters, war or riots.
8.2 In the event that a natural disaster or situation beyond control occurs during the trip and some services cannot be provided or the trip must be terminated early, Amapa Tours will only reimburse the costs of the services not provided. This only applies if Amapa Tours GmbH receives reimbursement from the suppliers. The client is not entitled to a partial refund in this case. Any additional expenses such as accommodation, transfers, flight changes, etc., will be covered directly by the client.
8.3 Amapa Tours is not responsible for expenses incurred due to flight delays, itinerary changes, strikes or other unforeseen conditions.
9. Civil liability:
9.1. Amapa Tours liability is limited; clients agree that any damage or loss may not exceed the total cost of the tour paid.
9.2. Amapa Tours is solely responsible for booking the tours it offers, including hotels, tours, transfers (including motorcoaches, boats, trains, or other means of transportation), guides, porters, and food from various suppliers.
9.3 Service providers are not agents, servants or employees of Amapa Tours but are independent workers or organizations that provide tourist services to Amapa Tours.
9.4 Amapa Tours is not responsible for any damage, including injury, accident, or loss of personal belongings due to any cause, act, or omission of the supplier or third parties.
9.5 Amapa Tours GmbH is not liable for acts of injustice or negligence caused by any travel agent or travel agency.
9.6 In the event of any errors in billing for services, whether human or computer-related, Amapa Tours GmbH reserves the right to correct the invoice and resend it.
10. Insurance:
10.1. Travel insurance services are not included in the package price. We recommend purchasing travel insurance to cover any unforeseen expenses that may occur during your trip.
11. Passport, visa and medical care:
11.1. For travel to Mexico, customers must have a passport valid for at least 6 months.
11.2. Tourists in Mexico are issued a visa valid for 90 days. Upon arrival, tourists must complete a card with their information. This card is given to them during their arrival flight before passing through immigration. Tourists must keep this document, along with the stamp they will receive at immigration, throughout their trip. Upon departure, they must show this card to the immigration officer. Failure to do so will result in a fine.
11.3. The client must consult a doctor to find out about the vaccinations they need before traveling.
11.4 Amapa Tours is not responsible for the costs of any medical consultations the client requires during the tour. It is also not responsible for the medical care received.
11.5. Amapa Tours is not responsible for any other costs incurred during the tour.
These terms and conditions apply to all services offered by Amapa Tours and may be modified by Amapa Tours at any time. However, any changes made will not apply to reservations already confirmed by us. It is essential that the client read, save, or print a copy of these terms and conditions to be aware of the measures to be taken.
These terms and conditions are effective from February 2016.
